Jamaica’s Constitutional Court has ruled that the environmental permit granted in 2020 to Bengal Development Limited for a proposed limestone mining project in the Dry Harbour Mountains was unconstitutional, void, and of no effect.
The decision marks a major victory for residents of St. Ann who challenged the approval, arguing that the mining operation threatened their constitutional right to a healthy environment.
The controversial project was planned for the ecologically sensitive Dry Harbour Mountains area, raising concerns among environmental advocates and community members about potential damage to the region’s natural resources and ecosystem.
Prime Minister Dr. Andrew Holness, acting in his role as minister responsible for the Natural Resources Conservation Authority, had previously overturned the agency’s rejection of the mining application and approved the permit.
The court’s ruling now blocks the proposed quarrying operation and reinforces constitutional protections related to environmental rights in Jamaica.
