Ruling Orders Dominican Woman to Repay Brother 1.7 Million Dollars for Unauthorized Sale of Property

Gloria Shillingford is to compensate her brother Angel Andrew 1.7million EC dollars after he gave her power of attorney over a property belonging to him. Ms. Shillingford consequently made unauthorized payments to herself, her daughter and their cousin Hillary Shillingford, with whom she had entered into an exclusive agreement and had paid a commission.

The Caribbean Court of Justice (CCJ) examined her leading ground of appeal, which was that the trial should be voided because the judge had allowed the trial to proceed despite violations of procedural rules. The High Court and Court of Appeal had ordered Ms. Shillingford to repay and the CCJ confirmed the decisions of the Courts. She was ordered to also pay her brother his basic costs.

Trial Judge Justice Cottle found that payments to Hillary Shillingford were made without authority and the exclusive agreement was fabricated by Hillary and herself in order to withhold a substantial part of the payments from Mr. Andrew. The Court of Appeal agreed with Justice Cottle and found that these payments were unauthorized.
